The 1% Myth: Why You Don’t Need a  Private Island to Need a Trust

For many families, that number  feels like it belongs in a different zip code. It’s easy to think, “If I’m not in the 1%, I don’t need a Trust.” 

But here is the reality I share with my clients: If you think Trusts are just for the ultra-wealthy, you’re  looking at the wrong set of numbers. A Trust isn’t about how much you have; it’s about how much you  want to keep for your family. 

It’s Not a Tax Dodge—It’s a Speed Pass 

While the OBBBA effectively eliminated federal estate taxes for most of us, it did nothing to fix the New  Jersey probate process. A Will is essentially a letter to a judge; it requires court permission (probate)  before your family can touch your assets. This process is public, often slow, and carries mandatory court  fees. 

A Revocable Living Trust acts as a “speed pass.” Because the Trust technically owns the assets, they  transfer to your heirs immediately and privately. Your neighbors don’t need to know what you owned,  and your kids don’t need to wait six months to pay the mortgage.

Protection Beyond the Grave 

Trusts offer “remote control” that a Will simply cannot. 

Minor Children: A Trust ensures that if something happens to you, your life insurance isn’t  handed to an 18-year-old in one lump sum. You can stagger distributions for college, a first  home, or age milestones. 

Incapacity: Unlike a Will, which only triggers upon death, a Trust protects you now. If you  become ill, your co-trustee can step in and manage your affairs without a messy court-ordered  guardianship. 

The NJ Inheritance Tax: Even with federal taxes gone, New Jersey still taxes “lateral” heirs (like  siblings or nieces). A properly structured Trust can help manage these liabilities.
